Welcome to the Patient Portal. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our platform.

1. Acceptance of Terms

By creating an account, accessing, or using the Patient Portal (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Notice of Privacy Practices. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

The Patient Portal provides a secure online platform that allows patients to:

  • View and manage prescription orders
  • Request prescription refills
  • Track shipment and delivery status
  • Access billing statements and make payments
  • Update personal and contact information
  • Communicate with pharmacy staff
3. Eligibility

To use the Service, you must:

  • Be at least 18 years of age, or have parental/guardian consent
  • Be a current or prospective patient of our pharmacy services
  • Provide accurate, current, and complete registration information
  • Maintain the security of your account credentials
4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to:

  • Create a strong, unique password and keep it confidential
  • Notify us immediately of any unauthorized access to your account
  • Log out of your account after each session, especially on shared devices
  • Not share your account credentials with any third party

We reserve the right to suspend or terminate accounts that we believe have been compromised or are being used in violation of these Terms.

5. Identity Verification

To protect your privacy and ensure the security of your health information, we require identity verification before granting access to your patient records. Verification may be completed through:

  • Providing personal information that matches our records (date of birth, insurance information, etc.)
  • Using an invitation link sent to your verified email address
6. Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any fraudulent or unlawful purpose
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use any automated system to access the Service
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or store personal data about other users
7. Medical Disclaimer

IMPORTANT: The Patient Portal is NOT intended to provide medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on this portal.

If you think you may have a medical emergency, call your doctor, go to the emergency department, or call 911 immediately.

8. Prescription Services

All prescription medications dispensed through our pharmacy require a valid prescription from a licensed healthcare provider. By requesting refills through the Patient Portal, you acknowledge that:

  • All refill requests are subject to verification and approval
  • Refills may be denied if the prescription has expired or has no remaining refills
  • We may contact your healthcare provider to verify or renew prescriptions
  • Controlled substances are subject to additional regulations and restrictions
9. Payment Terms

You agree to pay all charges associated with your prescriptions and services, including applicable copays, coinsurance, and amounts not covered by insurance. Payment is due at the time of service unless other arrangements have been made. We accept major credit cards and other payment methods as displayed on the portal.

10. Shipping and Delivery

Medications will be shipped to the address on file. You are responsible for ensuring your shipping address is accurate and that someone is available to receive temperature-sensitive medications. We are not responsible for medications that are damaged, lost, or stolen after delivery.

11. Privacy and Protected Health Information

Your privacy is important to us. Our use and disclosure of your protected health information (PHI) is governed by the Health Insurance Portability and Accountability Act (HIPAA) and our Notice of Privacy Practices. Please review our Privacy Policy for detailed information about how we collect, use, and protect your information.

12. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of the pharmacy and its licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless the pharmacy, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the portal and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State in which our principal place of business is located, without regard to its conflict of law provisions.

18. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
